プライバシーの権利に関する特別報告者、ジョセフ・ケナタッチ博士が登場。報告書（A/HRC/43/52 未編集先行版）、会合（採録）とも日本への言及は無い。韓国、中国ならびに中国人権研究会（CSHRS）が発言。昨年七月に特別報告者が韓国へ国別訪問を行なっていた *1 ：「韓国においては、非政府組織と政府の両方がサイバーいじめの被害者を支援し、これは非常に良い対応と見なされた」。親日的言動への「いじめ」は対象外だろう。訪問報告書は数か月以内に発表するとの由。中国に言及したが、「ベストプラクティスを採用するマンデートに向き合うよう奨励」と回りくどい。

The Human Rights Council this morning held separate interactive dialogues with the Special Rapporteur on the right to privacy, Joseph Cannataci, and the Special Rapporteur on adequate housing, Leilani Farha. It also concluded its interactive dialogue with the Special Rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism, Fionnuala Ní Aoláin.

Turning to the issue of children and privacy, Mr. Cannataci reminded that he had addressed the Committee on the Rights of the Child in January 2020. He had also carried out official country visits to Argentina and the Republic of Korea. He would share his reports on those visits with the concerned States in the coming months. As for the issue of security and surveillance, the Special Rapporteur said that in October 2019 he had held a highly successful fourth forum of the International Intelligence Oversight Forum in the United Kingdom, drawing more than 160 participants. In addition, his mandate had also dealt with individual cases of Julian Assange and the President of Ecuador Lenin Moreno. In September 2019, the Special Rapporteur had held a meeting of the Taskforce on the Use of Personal Data by Corporations in Brussels. In conclusion, Mr. Cannataci said that he would work on a new initiative on prisoners and privacy.

Concluding Remarks by the Special Rapporteur on the Right to Privacy

JOSEPH CANNATACI, Special Rapporteur on the right to privacy, concurred that the Internet should be a safe space for privacy, but it was not due to lack of political will, and this had to be regulated. As for best practices, in the Republic of Korea, both non-governmental organizations and the Government assisted victims of cyber bullying and this was considered a very good response. Stories of women suffering from revenge porn and other sexual based incidents were heart-breaking. China was encouraged to engage with the mandate to adopt best practices when it came to remedies to surveillance. When it came to encryption, Mr. Cannataci said that the right to privacy was not an absolute right and encryption was the strongest technical mean that they had to protect it. States were asked to provide additional resources to be able to carry out the work of the mandate.

The Human Rights Council this morning held an interactive dialogue with the Special Rapporteur in the field of cultural rights, Karima Bennoune. It also began an interactive dialogue with the Special Rapporteur on the situation of human rights defenders, Michel Forst, and concluded an interactive dialogue with the Special Rapporteur on the right to food, Hilal Elver.

イロ・アルビノ患者による権利の享受に関する独立専門家との双方向対話。昨年の第三委員会報告（A/74/190）で、地毛が茶髪の生徒に対する校則問題をまるっとアルビノ差別として扱うのはどうなのか的に取り上げたのだが、
今回の報告（A/HRC/43/42）では修正されて（？）いじめにウェイトが移り、いじめへの対処における「学校当局から」の「指示」についての指摘となっているようだ（パラグラフ32）。なお（コロンビアと）日本からの報告では、「アルビノの子どもたちは障害者として認められていないため、約60パーセントの子どもたちが政府から障害者証明書を取得していない（as children with albinism are not recognized as being disabled, approximately 60 per cent of them fail to obtain a disability certificate from the Government）」としている（パラグラフ40）。

32. いじめ事件は学校環境に限ったことではない *22 。一部地域においては、アルビノの子どもたちは社会のさまざまな領域でいじめられている。日本のある非政府組織は、おもにアルビノの子どもの髪の色のために、いじめが一部現地の学校において依然として顕著であると表明した。いじめを終わらせるための学校当局からの効果的な対応がないため、多くの親が子どもの髪の色を黒に変え、同級生や学校当局に受け入れられている。場合によっては子どもたちは学校当局から髪を黒く染めるよう指示されている。

2. 教育へのアクセス
37. アルビノの子どもたちは一般に、他の子ども同様に教育へのアクセスが保証されているが、学校において十分な支援の提供を確保するには大きな課題がある *30 。教師は通常、アルビノの子どもたちへの妥当な宿泊施設や一般的な支援的学習環境を提供する方法について十分な知識を持っていない *31 。場合によっては、教師は、アルビノに伴うあらゆる範囲とは対照的に、視覚障害のある子どもだけを支援するよう訓練されている *32 。

40. 他の報告では、子どもたちが一定の基準を満たしている場合にのみ政府の支援が利用可能であることが指摘された。例えば、日本からの提出によれば、アルビノの子どもたちは障害者として認められていないため、さもなければ必要なサービスやリソースへのアクセスが促進されるであろう約60パーセントの子どもたちが政府から障害者証明書を取得していないことを示している *38 。場合によっては、アルビノの子どもたちへの支援器具の提供は考慮されず、優先もされない。これは、障害者のための合理的配慮のための法律の規定が存在するにもかかわらずである *39 。ヨーロッパからの提出物には、いくつかの称賛に値する措置が記載されている。アルビノの子どもたちは一般に、大きな活字の本や特殊な眼鏡などの適応器具をほかよりも容易に利用できる。しかしながら、これは教育システム全体で常に保証されているわけではない。ノルウェーにおいてアルビニズムに取り組んでいるある組織は、補助器具は一般に幼児教育全体で利用できるが、高等教育においては必ずしもそうではないと指摘している

*39. タンザニア連合共和国からの提出。42. オーストラリアと日本におけるアルビノの子どもたちの就学率はほぼ100パーセントであるが、ラテンアメリカの一部地域においては中退率が非常に高いと報告されており、とくに貧しい家庭のアルビノの子どもたちが、家族を支えるために仕事を求めて学校を去っている *42 。中退率はブルキナファソにおいても高く、アルビノの女児の30パーセントが小学校を卒業していない *43 。ブルンジにおいては、アルビノの人々の56パーセントが学校教育を修了しておらず、アルビノの女児の20パーセントが小学校を修了していない *44 。ザンビアのある市民社会団体は、アルビノの子どもたち3,000人のうち小学校を卒業するのは3人だけだと推定している。

3. 医療へのアクセス
48. アルビノの子どもたちがいる世界中の多くの母親は、この病気に関する情報を持つ専門家にめったにアクセスできない。そのため、子どもの発達に不可欠な早期の医療介入を受けることはめったにない *55 。したがって、乳幼児の母親は、視力障害に関する情報や皮膚がんから守るための対策など、アルビノの子どもの世話の方法に関する必要な情報を持っていないことが多い *56 。これは、容易に予防できた皮膚癌の発症につながる可能性がある。さらに、アルビノに関する適切な健康情報の欠如は、アルビノの子どもたちの母親のあいだで悩み、抑うつおよび自己非難にもつながっている。報じられたところでは、母親はアルビノの子どもを出産した後、産後うつ病に苦しんでおり、子どものために利用できるサービスや必要な心理社会的ケアおよび支援に対する権利について十分に知らされていない *57 。

4. 性と生殖に関する健康
51. いくつかの国々における市民社会組織は、アルビノの女性と女児が性と生殖に関する医療サービスへのアクセスを制限、またはまったく利用できないと報告した。提供された理由には、烙印と医療提供者からの差別が含まれる *61 。

6. 適切な生活水準へのアクセス
60. とくにアフリカ、アジアおよびラテンアメリカの一部においてアルビノの人の権利に取り組んでいる組織のあいだでは、アルビノにより影響を受けた多くの女性と子どもたちが極度の貧困のなかで暮らしているという一般的コンセンサスがある *72 。これは、障害と貧困のあいだの一般的な相関関係を反映している *73 。また、シングルマザーであることや、女性が汚名を着せられ、孤立し、排斥されている状況とも関連している *74 。さらに、学校を早期に中退すると、しばしば経済的機会が制限される。

The Human Rights Council this morning held an interactive dialogue with the Special Rapporteur on the sale and sexual exploitation of children, Maud de Boer-Buquicchio. The Council also concluded its interactive dialogues with the Special Rapporteur on the rights of persons with disabilities, Catalina Devandas, and with the Special Rapporteur on the right to freedom of religion or belief, Ahmed Shaheed.

In addition, due to the global COVID-19 situation, Ms. Tichy-Fisslberger announced that following the recommendations of the Director-General of the United Nations Office at Geneva, Tatiana Valovaya, the Bureau of the Human Rights Council had decided to cancel all side events and would encourage representatives and those Special Procedure mandate holders who were not already in Geneva to refrain from travelling to Geneva and to participate in the session via videoconference.
